Musk accuses Altman of betraying OpenAI mission as explosive courtroom battle opens in California
A high stakes legal battle between two of the most influential figures in artificial intelligence has begun in California, where Elon Musk and Sam Altman are facing off over the origins, direction and future of OpenAI.
The trial opened in Oakland with sharply different narratives from both sides. Musk claims OpenAI abandoned its founding mission as a nonprofit research organization created to benefit humanity. OpenAI, meanwhile, argues that Musk is attempting to damage a rival after leaving the company years ago.
The case has drawn global attention because it goes beyond a personal dispute. At its center are major questions about control of advanced AI, corporate governance, charitable obligations and the future of one of the world’s most powerful technology companies.
Musk says OpenAI was transformed from public mission into private gain
Taking the witness stand, Musk described the case in blunt terms.
“It’s actually very simple,” he said. “It’s not okay to steal a charity.”
According to Musk, OpenAI was founded with a commitment to develop artificial intelligence safely and openly for the public good. He alleges that the company later shifted away from that promise by building a commercial structure that enriched insiders and investors while using nonprofit roots to build trust and attract support.
Musk’s legal team argued that OpenAI leaders, including Altman and co founder Greg Brockman, changed the nature of the organization after Musk helped fund and launch it.
His lawyer told jurors that without Musk, OpenAI would not exist in its current form. Musk reportedly donated about $38 million during the company’s nonprofit phase, helping fund early operations and research.
The lawsuit seeks billions of dollars in what Musk’s lawyers describe as wrongful gains. He is also pushing for reforms at OpenAI, including leadership changes.
OpenAI says Musk is attacking a competitor
OpenAI strongly rejected Musk’s claims during opening arguments.
Its lawyer said the case is not about charity or principle, but competition. According to the company, Musk became hostile after losing influence at OpenAI and now wants to weaken a major rival to his own AI venture, xAI.
“We’re here because Mr Musk didn’t get his way at OpenAI,” OpenAI’s attorney told the court.
The company also alleged that Musk once tried to merge OpenAI with Tesla, which he leads, and that other founders refused to place such powerful technology under the control of one person.
OpenAI argues that Musk understood and supported the decision to create a for profit arm when it became clear that developing advanced AI systems would require vast computing resources, talent and capital.
The company further claims Musk only left after failing to become chief executive.
Why the dispute matters far beyond the courtroom
This trial is being closely watched because OpenAI has become one of the most important companies in the global AI race.
Its chatbot ChatGPT helped trigger widespread commercial adoption of generative AI and accelerated competition among major firms including Google, Microsoft, Meta and Musk’s xAI.
If the court accepts parts of Musk’s case, it could reshape how nonprofit technology organizations convert into commercial entities. It may also affect how future AI labs structure governance, fundraising and public commitments.
If OpenAI prevails, it would strengthen the company’s argument that large scale AI development requires flexible commercial models capable of raising billions of dollars.
Judge warns both sides over public comments
The courtroom drama has also spilled online.
Judge Yvonne Gonzalez Rogers said she would not impose a gag order but warned both sides against using social media or public statements to influence proceedings.
That warning followed a post by Musk on X in which he referred to Altman using insulting language.
The judge asked for a clean slate moving forward and urged participants not to inflame tensions outside the courtroom.
Altman and Brockman also agreed to avoid escalating the dispute publicly.
From allies to rivals in the AI race
The public clash marks a dramatic turn in the relationship between Musk and Altman.
Both were early supporters of OpenAI when it launched in 2015 as a nonprofit focused on safe and broad access to AI research. At the time, concerns were growing that a handful of corporations might dominate artificial intelligence.
Over the years, OpenAI changed course, adding a capped profit model and later deep commercial partnerships. That shift helped finance the enormous cost of training modern AI systems.
Musk left OpenAI long before ChatGPT became a global phenomenon. Since then, he has repeatedly criticized the company, its leadership and its ties with Microsoft.
He later launched xAI and introduced the chatbot Grok, placing himself directly into the AI competition.
What happens next
The trial is expected to include testimony from Altman and other key figures involved in OpenAI’s formation and transformation. Internal communications, funding discussions and governance decisions may all come under scrutiny.
A verdict is expected in late May.
Whatever the outcome, the case has already become one of the defining legal battles of the AI era. It combines personal rivalry, billion dollar stakes and unresolved questions about whether organizations founded for public benefit can later become dominant commercial powers.
